The Auto Collision Group website, located at autoacg.com (the “Site”), serves as an online platform where you can explore and gather information about the different services offered by Centers (“ACG”). Access to this Site is granted only under the condition that you agree to abide by the terms and conditions outlined below. Nothing on this Site should be interpreted as establishing any form of warranty or additional responsibility on the part of ACG.
Agreement. We strongly encourage you to review the following information before using this Site. If you do not agree with any portion of this Agreement, refrain from using the Site. ACG retains the right, at its sole discretion, to modify, amend, or update this Agreement at any time. By continuing to use this Site after any modifications are posted, you agree to those changes. Any updates will take effect only from the date they are implemented and will not apply to any disputes that arose before the update date.
Disclaimer of Warranties: Limitation of Liability. THIS SITE AND ITS CONTENT ARE OFFERED “AS IS” WITHOUT ANY KIND OF WARRANTY, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, SUITABILITY FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. These warranties are excluded to the maximum extent allowed by applicable law. UNDER NO CIRCUMSTANCES SHALL ACG BE RESPONSIBLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES THAT MAY RESULT FROM YOUR USE OF OR INABILITY TO USE THIS SITE OR ITS CONTENT. In certain jurisdictions, the exclusion or limitation of liability for consequential or incidental damages may not be allowed. In those areas, our liability is limited to the maximum extent permitted by law, or $10.00, whichever amount is lower.
Privacy: Any personal data submitted to ACG will be handled in line with our Privacy Policy.
Our Copyrighted Materials: Infringement Claims. The copyrights for all text, images, screens, and other content available on this Site (collectively referred to as the “Materials”) are owned by ACG and/or third parties. Unless otherwise stated, none of these Materials may be reproduced, distributed, displayed, downloaded, or transmitted in any form or by any means without obtaining prior written consent from ACG or the copyright holder. Unauthorized use of any Materials on this Site could infringe upon copyright laws, trademark laws, privacy and publicity laws, and/or other applicable regulations and statutes.
Trademarks. Any trademarks and service marks mentioned on this Site are owned by ACG or their respective owners. Nothing on this Site should be interpreted as granting any license or right to use any trademark, either by implication, estoppel, or any other means, without obtaining our written consent. The ACG name or logo cannot be used in any form, including for advertising or promotional purposes related to the distribution of materials from this Site, without prior written approval. You are not permitted to use our logo as a hyperlink to this Site unless you have received prior written consent from ACG, although we do allow the use of certain designated features of the Site to use our logo as a hyperlink for specific purposes.
Right to Preserve and Disclose. ACG may retain all information you provide. Additionally, ACG may disclose such information if required by law or if, in good faith, it believes that preserving or disclosing the information is reasonably necessary to: (a) complete your transaction; (b) comply with legal requirements; (c) enforce this Agreement; (d) address claims that any materials on this Site infringe upon your rights or the rights of others; (e) safeguard the rights, property, or personal safety of ACG, its users, and/or the public; or (f) in the event that a third party acquires all or substantially all of ACG’s assets.
Prohibited Actions. You agree not to: (a) decompile, reverse engineer, disassemble, modify, or create derivative works based on the Site or any part of it, or reduce it to a human-readable form; (b) disable any licensing or control features of the Site; (c) introduce any viruses, code, or routines intended to disrupt, damage, or alter the Site, its Materials, or to gather or record information about the Site or its users; (d) combine the Site or its Materials with another program or create derivative works from them; (e) remove, obscure, or modify any copyright notice or proprietary labels on the Site or its Materials; (f) sublicense, assign, translate, rent, lease, lend, resell, distribute, or transfer the Materials or access to the Site to others; (g) use the Site or Materials in violation of any applicable law, regulation, or rules from regulatory or administrative bodies, whether federal, state, local, foreign, or otherwise; or (h) engage in any fraudulent, illegal, malicious, or negligent activities while using the Site. Except as explicitly stated, ACG and third parties retain all rights concerning the Site and may pursue all legal options available under both civil and criminal law (and may cooperate with law enforcement) in the event of any violations.
Issuance of Passwords. Some sections of this Site do not require a password. Where a password is necessary, you must register, and the password you create will be activated shortly thereafter to allow access to the password-protected areas of the Site. Passwords are intended for use by a single individual and must not be shared. Each user is responsible for remembering and securing their password and ensuring it is not disclosed to others. Be sure to select a strong password, which should include numbers, uppercase letters, special characters, etc., and avoid using common words found in a dictionary. If your password is lost or stolen, you are responsible for notifying ACG using the contact information provided in the “Contact Us” section.
Prohibition on Scripts, Bots, Third Parties, etc. You are prohibited from accessing or using the Site through any automated software, expert systems, electronic agents, or “bots,” and you may not grant access to the Site to any individual or organization.
Ownership of Usage Data. ACG may gather and compile data related to your use of the Site, and ACG will retain exclusive ownership of this information.
Links. While ACG manages some hyperlinks on the Site, certain links may direct you to third-party websites. ACG provides these links solely for your convenience. The inclusion of a link does not signify endorsement of the linked site, its operator, or its content, nor does it imply any affiliation between ACG and the linked site. The Site does not adopt any materials from linked sites by reference. ACG reserves the right to remove any link to a third-party website at its discretion. ACG does not control third-party websites, which may have their own terms of use and privacy policies, and ACG encourages you to review them.
Must Be At Least 18 Years Old to Use This Site. ACG does not actively seek to collect personal information from individuals under the age of eighteen (18) on this Site. Users of the Site must be of legal age to enter into agreements, which is generally considered to be at least eighteen (18) years old or older.
Site Controlled from the United States. This Site is operated from offices in the United States. ACG does not claim that the content or materials on this Site are suitable or available for use in other regions. Accessing this Site from jurisdictions where such access is prohibited by law is strictly forbidden. If you decide to access the Site from other regions, you do so at your own risk and are responsible for complying with all relevant laws. Not Authorized to Do Business in All Jurisdictions. ACG is not permitted to conduct business in all regions. The information available on this Site may include references or cross-references to products or services that may not be offered in your state or country.
Entire Agreement; Severability. By using this Site, you confirm that you have read, understood, and agree to comply with the terms and conditions of this Agreement. You also agree that this Agreement, along with the Privacy Policy (which is incorporated into this Agreement by reference), represents the complete and exclusive understanding between you and ACG, replacing any prior oral or written proposals, agreements, or communications related to the subject matter of this Agreement. If any part of this Agreement is deemed unenforceable, it will not affect the validity of the rest of the Agreement, which will continue to be valid and enforceable in accordance with its terms.
