CALIFORNIA PRIVACY POLICY

This California Privacy Notice (the “Notice”) supplements the information provided in Auto Collision Group’s (ACG) Privacy Policy and applies exclusively to site visitors or customers who reside in California. It is issued in accordance with the California Consumer Privacy Act of 2018 (“CCPA”), as amended by the California Privacy Rights Act of 2020 (“CPRA”). Certain terms used herein have the meanings defined under the CCPA, CPRA, and their respective regulations.

 

At Auto Collision Group (ACG), we are dedicated to safeguarding your personal information and ensuring its security. This Notice outlines how ACG collects, uses, and retains your personal information, the circumstances in which your personal information may be shared with third parties, and your privacy rights and choices under California law. For the purposes of this Notice, “Personal Information” refers to data that identifies, relates to, or describes an individual or household, or that can be reasonably associated or linked, directly or indirectly, with a particular person or household. Please note that “Personal Information” does not include data that is publicly available, anonymized, or aggregated, nor does it encompass information excluded from the scope of the CCPA/CPRA (for example, data covered by other privacy laws such as the Fair Credit Reporting Act, the Gramm-Leach-Bliley Act or California Financial Information Privacy Act, and the Driver’s Privacy Protection Act).

 

This Notice does not apply to Personal Information that we collect when:

 

  • You are acting as a job applicant to or employee or independent contractor of Auto Collision Group (ACG).
  • You have been designated as an emergency contact for a job applicant or employee, and your information has been collected for use solely within that context.
  • We need your Personal Information to administer benefits obtained through an employee.
  • We are collecting or processing your information as a service provider to a third party. If you arrived at this Notice through a link located on a website operated or hosted on behalf of your insurance provider, then please refer to your insurer’s Privacy Policy for more information about how your insurer collects, processes, retains, and shares your Personal Information, and your rights related thereto.

 

We reserve the right to amend this Notice at our discretion, at any time and without sending notice to you. When we make changes to this Notice, we will post the updated Notice on this web page and update the effective date. This Notice is not a contract and does not create any contractual rights or obligations.

 

Collection and Retention of Personal Information

Through our website and services, Auto Collision Group (ACG) collects and processes certain categories of Personal Information about you. As permitted by law, we collect—and within the last twelve (12) months have collected—the following categories of Personal Information:

 

  • Identifiers: Your name, phone number, email address, and home address.
  • Information under California Civil Code § 1798.80(e): Details such as your signature, insurance policy number, and credit or debit card information.
  • Sensitive Personal Information: Government-issued identifiers like your driver’s license and state identification card numbers.
  • Protected Classification Characteristics: Data such as your age and military status, particularly if you participate in ACG’s promotional programs (e.g., Military Discounts and Senior Discounts).
  • Commercial Information: Records of services you have purchased or obtained from ACG or its affiliates (for example, estimates, invoices, and work orders).
  • Internet or Network Activity: Information including the date and time of access, URL addresses of webpages visited, your internet domain and IP address, browser type and operating system, the referring page’s URL, the status of webpage requests, and the file size of webpages accessed.
  • Geolocation Data: Data such as your IP-based location.
  • Sensory Data: Information collected from call monitoring and video surveillance.
  • Professional or Employment-Related Information: To the extent you submit an inquiry regarding employment opportunities.
  • Non-Public Education Information: As defined by the Family Educational Rights and Privacy Act (20 U.S.C. Section 1232g, 34 C.F.R. Part 99), if you inquire about employment opportunities.
  • Vehicle-Related Data: Information such as your vehicle’s license plate number, vehicle identification number, odometer and mileage data, vehicle systems data (e.g., diagnostic codes), and photographs of your vehicle.
  • Inferences from Other Personal Information: Including profiles that reflect your preferences and attitudes.


At Auto Collision Group (ACG), we do not collect biometric information or the following categories of Sensitive Personal Information: complete account access credentials; precise geolocation data; racial or ethnic origin; religious or philosophical beliefs; union memberships; genetic data; mail, email, or text message content not directed to us; unique identifying biometric information; or information related to health, sex life, or sexual orientation.

 

At Auto Collision Group (ACG), we collect Personal Information directly from you when you or your authorized agent provide it to us. Additionally, we gather information indirectly through your activities on our website (such as submissions via our website portal or automatically collected usage details) and while delivering our services. Both ACG and our third-party partners may utilize cookies, web beacons, or other technologies to collect and store information about your visit to or use of our websites. Moreover, we obtain information from additional sources, including third parties that interact with us in connection with our services, marketing partners and commercially available third-party sources, as well as publicly available sources or databases.

 

Auto Collision Group (ACG) generally retains all categories of Personal Information and Sensitive Personal Information mentioned above for as long as necessary or permitted, considering the purpose for which the information was obtained. This includes providing services to you, completing transactions, communicating with you about our services, conducting internal research, evaluating usage, troubleshooting, analyzing data to improve service quality, or fulfilling legal, regulatory, contractual, or insurance obligations. We retain Personal Information and Sensitive Personal Information in accordance with our record retention policies, which are guided by business needs and legal or contractual requirements. The criteria we use to determine retention periods include: (1) as long as we maintain an active relationship with you; (2) when a legal obligation requires us to retain the information (e.g., statutory retention periods or fulfilling commitments under our warranty programs); or (3) when advisable based on our legal position (such as in relation to statutes of limitations, litigation, or regulatory investigations). If, for technical reasons, we are unable to completely delete certain data from our systems, we will implement appropriate measures to prevent further processing or use.

Purposes for Collecting and Processing Personal Information

Auto Collision Group (ACG) may collect, use, or disclose the above categories of Personal Information and Sensitive Personal Information for the following purposes:

 

  • To fulfill, address, or respond to the reason you provided the information or to complete the transaction you requested. For example, if you share your name and contact details to inquire about our services or employment opportunities, we will use that information to respond to your inquiry. If you provide your personal information to purchase or authorize a service, we will use it to process your payment, facilitate the service, and update you on its status. We may also retain your information to streamline future orders and services, as well as to facilitate warranty repairs.

 

  • To provide, support, personalize, and enhance our website and services.

 

  • To process your requests, purchases, transactions, and payments, while also preventing fraud.

  • To offer customer support and respond to your inquiries, including investigating and addressing concerns, as well as monitoring and improving our responses and services.

 

  • For testing, research, analysis, and service development, including improving our website and services.

 

  • To respond to inquiries or investigations by regulators or other governmental agencies.

 

  • To comply with law enforcement requests and legal requirements, including court orders or regulations.

 

  • To seek payment from insurers or respond to insurance-related investigations.

 

  • To evaluate or facilitate a merger, divestiture, restructuring, reorganization, dissolution, or any other sale or transfer of some or all of our assets—whether as an ongoing business or as part of bankruptcy, liquidation, or similar proceedings—where Personal Information held by ACG about consumers is among the transferred assets.

 

  • As described to you at the time of data collection or as otherwise permitted by the CCPA/CPRA.

 

Auto Collision Group (ACG) will not collect additional categories of Personal Information or Sensitive Personal Information, nor will we use the Personal Information or Sensitive Personal Information we have collected for materially different, unrelated, or incompatible purposes without providing you with notice. We only use the Sensitive Personal Information collected about you (e.g., driver’s license number) for purposes expressly permitted under the CPRA—namely, to perform our services or complete our transaction with you.




Disclosure of Personal Information

Auto Collision Group (ACG) does not sell, trade, or rent your Personal Information to unaffiliated third parties, such as sellers of goods or services, for their own business or commercial purposes. ACG will only disclose or share your Personal Information with our affiliates and certain trusted parties, specifically:

 

  • Affiliates and subsidiaries, when permissible under relevant laws and regulations, for various purposes, such as improving our suite of products and services across all related businesses or marketing vehicle-related products and services to you.

 

  • Service providers and vendors to perform functions and provide services, including but not limited to: payment processing; marketing and non-marketing communications; business analytics (both marketing and non-marketing); IT and network administration, such as data storage and management, website hosting, and data security; professional advisory services related to legal, accounting, and tax matters; and general business operation support, such as courier services, document destruction, and electronic signatures.

 

  • Governmental authorities or other entities as required by law or regulation.

 

  • Other third parties to whom you or your authorized agent authorize us to share personal information in connection with the services we provide.

 

In the last twelve months, Auto Collision Group (ACG) has disclosed the following categories of Personal Information to our affiliates and/or service providers for the business purposes described above: (1) identifiers; (2) information described in California Civil Code § 1798.80(e); (3) commercial information; (4) internet or other similar network activity; (5) sensory data (e.g., call recordings and vehicle photographs); (6) inferences drawn from other Personal Information; and (7) Sensitive Personal Information limited to your driver’s license number. (We do not disclose Sensitive Personal Information for purposes other than those specifically permitted by the CPRA.)

 

We may also share certain categories of Personal Information, excluding Sensitive Personal Information, with third parties such as marketing and advertising platforms (including social media platforms) and data aggregation and brokerage companies for cross-context behavioral advertising purposes. This helps us improve the quality of your website experience, evaluate the performance of our marketing and advertisements, facilitate engagement with you, and display relevant information. In the preceding twelve months, Auto Collision Group (ACG) has shared the following categories of Personal Information for these purposes: (1) identifiers (your name, phone number, email address, and mailing address); and (2) internet or other similar network activity.

 

Your Rights and Choices

 

Right to Know. You have the right to request that we disclose certain information about our collection and use of your Personal Information over the past twelve months. Once we receive and verify your request, Auto Collision Group (ACG) will disclose to you:

 

  • Categories of Personal Information and Sensitive Personal Information we collected about you.
  • Categories of sources from which we collected your Personal Information and Sensitive Personal Information.
  • The business purpose for collecting, disclosing, or sharing that information.
  • Categories of third parties with whom we disclose or share that information.
  • Specific pieces of Personal Information and Sensitive Personal Information we collected about you (a “data portability request”).
  • If we shared or disclosed your Personal Information or Sensitive Personal Information for a business purpose, a list identifying the personal information categories that each category of recipient obtained.



Deletion. You have the right to request that we delete your Personal Information that we collected from you and retained, subject to certain exceptions. Once we receive and verify your request, Auto Collision Group (ACG) will delete (and direct our service providers to delete) your Personal Information from our records, unless retaining the information is necessary for us or our service provider(s) to:

 

  • Complete the transaction for which we collected the Personal Information, fulfill the terms of our written warranty in accordance with the Magnuson-Moss Warranty Act or other federal law, provide a service that you requested, take actions reasonably anticipated within the context of our ongoing business relationship with you, or otherwise perform our contract with you.
  • Detect security incidents, prevent malicious, deceptive, fraudulent, or illegal actions, and assist in prosecuting those responsible for such actions.
  • Debug to identify and repair errors that impair existing intended functionality.
  • Exercise free speech, ensure another consumer’s right to free speech, or exercise another right provided by law.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et seq.).
  • Engage in public or peer-reviewed scientific, historical, or statistical research in the public interest that adheres to all other applicable ethics and privacy laws, when deleting the information would likely make the research impossible or seriously impair its achievement, provided you previously gave informed consent.
  • Enable solely internal uses that are reasonably aligned with consumer expectations based on your relationship with us.
  • Comply with regulatory requirements or other legal obligations.
  • Respond to regulatory, law enforcement, or insurance investigations, or comply with a subpoena.
  • Make other internal and lawful uses of that information that are compatible with the context in which you provided it.


Auto Collision Group (ACG) may maintain a confidential record of deletion requests solely to prevent your Personal Information from being sold, to comply with applicable law, or for other purposes permitted under the CCPA/CPRA.

 

Correction. You may at any time direct Auto Collision Group (ACG) to correct any inaccuracies in the Personal Information we maintain about you. Upon receiving and verifying your request, we will use commercially reasonable efforts to correct the inaccuracy in your Personal Information. We may decline to make corrections if, based on the totality of the circumstances, we determine that the Personal Information we have on file is more likely than not accurate or if we determine the request is likely fraudulent or abusive. If we decline to correct the Personal Information, you may request that we note in our records and notify any service providers and third parties to whom we disclosed the allegedly erroneous information that its accuracy has been disputed.

 

Restrict Use or Disclosure/Sharing of Personal Information for Advertising & Marketing. Auto Collision Group (ACG) may use or disclose/share your Personal Information with our service providers and marketing providers for our own advertising and marketing purposes. You have the right, at any time, to request that we stop using or disclosing/sharing your Personal Information for advertising and marketing purposes. Once we receive and verify your request, we will no longer use or share your Personal Information for these purposes.

 

We also recognize browser-based opt-out signals as required by law. If we receive an opt-out signal and can identify the consumer to whom the signal relates, we will treat it as a request to opt out of all Personal Information we have on file for that consumer. If we receive an opt-out signal but cannot identify the consumer to whom it relates, we will treat the signal as a request to opt out only of the Personal Information collected during the online session in which the signal is present.

 

How to Exercise Rights & Choices. To exercise your rights regarding access, data portability, correction, deletion, and advertising use restriction as described above, please submit a verifiable consumer request to us by:

  • Submitting a completed CA Privacy Act Request Form (ejemplo)
  • Mailing or emailing us at the addresses provided at the end of this Notice (see “Contact Us”)

 

Only you, or a person legally authorized to act on your behalf, may make a verifiable request related to your Personal Information. You may also make a verifiable request on behalf of your minor child. You may only request access or data portability twice within a 12-month period.

 

Your request must:

 

  1. Provide sufficient information that allows us to reasonably verify that you are the person about whom we collected Personal Information or an authorized representative.

  2. Describe your request in sufficient detail to allow us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm that the requested Personal

 

Auto Collision Group (ACG) will acknowledge receipt of your request within ten (10) business days of receiving it and will make every effort to respond to a verifiable consumer request within forty-five (45) days. If we require additional time (up to an additional 45 days), we will inform you of the reason for the delay and the extension period in writing. We will deliver our written response either by mail or electronically, based on your preference.

 

Any disclosures Auto Collision Group (ACG) provides will only cover the 12-month period preceding our receipt of the verifiable consumer request. Our response will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will provide your Personal Information in a format that is readily usable and should allow you to transmit the information from one entity to another without hindrance.

 

Auto Collision Group (ACG) does not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that your request warrants a fee, we will inform you of the reason for our decision and provide you with a cost estimate before completing your request.

 

Non-Discrimination. Auto Collision Group (ACG) will not discriminate against you for exercising any of your rights under California law. Unless permitted by applicable law, we will not deny you goods or services, charge you different rates for goods or services, provide you with a different level or quality of goods or services, or suggest that you may receive a different rate or quality of goods or services based on your exercise of these rights.

 

However, Auto Collision Group (ACG) may provide certain financial incentives as allowed under California law, which could lead to variations in pricing, rates, or service quality. Any such incentive will be directly tied to the value of your Personal Information and will include written terms outlining the key details of the program. Your participation in these programs is entirely voluntary and requires your explicit opt-in consent, which you may withdraw at any time.
